The Claims Process

Everyday, personal injury claims are filed, testified, and taken to court. Many believe that all you have to do is file your claim, find a lawyer, go to court, and you are compensated soon after. However, this view of the claims process is incorrect and somewhat naïve. As simple as the process sounds, the claims process is not easy in anyway whatsoever. The process, unfortunately, can be stressful, tedious, complicated, and drawn out over a long period of time.

The first thing that must be considered before filing a personal injury claim is to realize who is at fault. If another person is liable for your accident, you are most definitely entitled to file a personal injury claim against that person. However, if the fault solely relies on yourself, you cannot file a claim. This is usually the part that most people overlook. Someone else cannot be held responsible for your injuries unless he/she was liable.

If it is clear that another person is liable for your accident, you should immediately write down the specific details of what happened. Even if law enforcement or medical attention is seek, these people do not always have the specific details that you do. If possible, take pictures of scene at which the accident took place and take pictures of any visible injuries that you may have. It is also important to write down any medical treatment that you receive.

Once a claim is filed, your insurance company will then processes and research your claim. To do this, the company obtains all the medical records, the police report, and any other information. The insurance company then and decides on their response. Sometimes your insurance company does not give you the full amount that you wish to be compensated. When this becomes true, it is up to the injured to decide if going to court is what needs to be done. If a compromise cannot be reached with the insurance company, most people do decide to go to court.

If and when you decide to take your claim to court, you should not wait to long. If the injuries you acquired from the accident are serious, you usually have a valid case. If you are not sure as to whether your injuries would be considered serious, you can always check your state’s Serious Injury Threshold. If your injuries do not meet or break this threshold, you do not have a valid case.

When filing your claim, it is important that you file it as early as possible. Most states have a Statue of Limitations on personal injury cases that usually range from 2-3 years. If you do not know your state’s limitation, it is best to research it.

Again, the claims process is not quick and easy. It requires patience and time.
